THIS IS A LEGALLY BINDING AGREEMENT AND IT HEREBY RELEASES MULTIPLE ENTITIES FROM ANY AND ALL LIABILITY RESULTING FROM ANY INJURY TO PERSON OR PROPERTY, YOUR SIGNATURE ON THIS DOCUMENT INDICATES YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT AND ASSENTED TO ITS TERMS.
We, the undersigned, enter into this agreement this _________ day of ______________, 2012, and agree to the following: 1. TERMS: The following terms used in this agreement shall be construed as hereinafter defined: a. "Release Party" shall mean Bristow; Paws & the Car Show Committee, its servants, employees, members, and agents, Bristow Chamber of Commerce, it servants, employees, members, and agents, as well as any and all participants and/or volunteers associated with facilitating 2012 Bristow Car, Truck & Bike Show, and the City of Bristow, its servants, employees, members, and agents, and the lawful owners of any and all facilities and/or real or commercial property involved with 2012 Bristow Car, Truck & Bike Show. b. "Releasing Party" shall mean the undersigned individual participant, entity, group, or other collaboration, its personal representative(s), heir(s), next of kin, and/or any person(s) claiming by or through the undersigned. c. "Claims" shall mean any and all rights that the Releasing Party may have to demand damages from the Released Party. CLAIMS INCLUDE, BUT ARE NOT LIMITED TO, ANY AND ALL DEMANDS FOR DAMAGES TO THE WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM AN ACT OR OMISSION OF THE RELEASED PARTY. 2. AGREEMENT. In consideration for the Releasing Party's allowed use of a 2012 Bristow Car, Truck & Bike Show Vendor or Food Booth or Entertainment Venue, Releasing Party hereby surrenders, releases, discharges, gives up any and all known or unknown Claims existing now or arising in the future as a result of the Releasing Party's actual or intended use of a 2012 Bristow Car, Truck & Bike Show Vendor or Food Booth or participation in any 2012 Car, Truck, & Bike Show Entertainment event. Additionally, Releasing Party covenants not to sue for any and all known or unknown Claims existing now or arising in the future as a result of Releasing Party's actual or intended use of a 2012 Bristow Car, Truck & Bike Show Vendor or Food Booth or participation in any 2012 Car Show Entertainment event. Releasing Party further agrees to indemnify and defend Released Party from any and all such claims. SIGNED THIS ____ DAY OF _______________, 2012 |
